How the West Virginia rule works
West Virginia's Wage Payment and Collection Act counts accrued fringe benefits, including vacation, as wages due in the final paycheck, but only to the extent the employer's own policy makes them earned and payable. In Meadows v. Wal-Mart Stores (W. Va. 1999), the state supreme court held that whether vacation has accrued and must be paid depends on the terms of the employer's policy, so a policy can limit or deny payout.
