How the Ohio rule works
No Ohio statute requires private employers to pay out accrued vacation when employment ends. The employer's policy or contract controls, enforced under ordinary contract law. Ohio Rev. Code §4113.15 lists vacation pay within its fringe-benefits definition for final-pay timing purposes but creates no payout right; Ohio courts have enforced clearly communicated written policies, including forfeiture clauses.
