When the cooling-off right applies in Iowa

The door-to-door window, the categories with their own clocks, and the purchases that are not covered.

When it appliesWhat it means
Three business days after signingThe buyer may cancel until midnight of the third business day, under Iowa Code § 555A.3. Section 555A.1 defines a business day to exclude Saturday, Sunday, and public holidays, so Saturday does not count against you.
25 dollars, counting interest and chargesThe right reaches a sale, lease, or rental of 25 dollars or more, and purchase price includes all interest and service charges, under § 555A.1. Invited solicitations and courses of instruction are covered.
Funeral and dating contracts, anywhere signedIowa treats prepaid funeral contracts and social referral services such as dating and matchmaking as door-to-door sales irrespective of where they are signed, under § 555A.1(3)(b).
Ten-business-day refund, note freezeThe seller must refund within ten business days under § 555A.4, and may not sell your note to a lender before midnight of the seventh business day.
When there is no rightWhat it means
Store, mail, and repair salesPrior negotiations at a fixed retail location, transactions entirely by mail or telephone, and repair or maintenance visits you requested are excluded, along with anything under 25 dollars.
Emergency waiversA buyer-initiated emergency purchase is excluded where you furnish a separate signed statement in your own handwriting waiving the three-business-day right.
Real property, insurance, securitiesReal property, insurance and prepaid health plans, and securities sold by a registered broker-dealer are outside the chapter, as is a transaction where you already have a TILA rescission right.
No contract copy voids the debt
Under § 555A.5, cancelling or the seller's failure to give you a copy of the contract voids any contract or note connected to it and is a complete defense to any suit on it. Iowa does not just extend your deadline, it can wipe out the debt.
Federal floor
The FTC Cooling-Off Rule (16 C.F.R. Part 429) gives three business days to cancel a door-to-door sale of 25 dollars or more at your home. Iowa's 25 dollar floor applies regardless of location, so it beats the federal 130 dollar floor for a hotel or fairground sale.

What you can do right now

Concrete, neutral steps to cancel a covered purchase in Iowa. This is consumer information, not legal advice.

  1. Cancel in writing within the window

Send written cancellation to the seller by midnight of the third business day. Use the detachable Notice of Cancellation the seller was required to attach, and keep proof of the date.

  2. Funeral or dating contract? You can still cancel

Iowa applies the three-day right to prepaid funeral and dating or matchmaking contracts no matter where you signed, even in a funeral home or an office.

  3. If you got no contract copy, the debt may be void

Under § 555A.5, a seller's failure to give you a copy of the contract voids any note connected to it and gives you a complete defense. Keep any partial paperwork you did receive.

  4. Complain if a valid cancellation is refused

File a complaint with the Iowa Attorney General, Consumer Protection Division.

What Iowa buyers get wrong about cancelling

Iowa's distinctive move is reach, not just a longer clock. Under Iowa Code § 555A.3 you have until midnight of the third business day to cancel a door-to-door sale of 25 dollars or more, with a ten-point boldface Notice of Cancellation attached to your contract. But Iowa also declares that, irrespective of where they are signed, prepaid funeral contracts and social referral services such as dating and matchmaking are door-to-door sales carrying the full three-day right. So you can cancel a prepaid funeral contract signed in a funeral home, or a matchmaking contract signed in an office. Iowa's enforcement is unusually sharp. If the seller never gave you a copy of the contract, section 555A.5 does not merely extend your deadline, it voids any note connected to the contract and hands you a complete defense to any suit on it. The seller also cannot sell your paper to a lender until the seventh business day, and purchase price counts interest and service charges, which makes the 25 dollar floor easier to clear than it looks. Courses of instruction are covered regardless of purpose.

Common questions

Can I cancel a prepaid funeral contract in Iowa even though I signed it at the funeral home?

Yes. Under § 555A.1(3)(b), Iowa treats prepaid funeral contracts as door-to-door sales irrespective of where they are signed, so the three-business-day right applies.

Does Iowa's three-day rule cover a dating or matchmaking service?

Yes. Iowa applies the door-to-door cancellation right to social referral services, including dating and matrimony services, no matter where you sign the contract.

The salesperson never left me a copy of the contract. Is the whole debt void?

It can be. Under § 555A.5, the seller's failure to give you a copy of the contract voids any note connected to it and is a complete defense to any action based on the contract.

Does Saturday count toward my three business days in Iowa?

No. Section 555A.1 defines a business day to exclude Saturday, Sunday, and public holidays, so Saturday does not count against you.
