Right to cancel a purchase · Alabama
Alabama gives three business days to cancel a door-to-door sale, but only for a credit-financed sale. A cash buyer has no state right and falls back on the federal FTC rule. If the seller never gave the written notice, the window stretches to one year.

When the cooling-off right applies in Alabama

The door-to-door window, the categories with their own clocks, and the purchases that are not covered.

When it appliesWhat it means
Three business days after signingA buyer may cancel a home solicitation sale until midnight of the third business day after signing, under Ala. Code 5-19-12(a). Written notice is effective when delivered or when mailed to the seller.
Only credit-financed sales are coveredThe right reaches only a consumer credit sale (Ala. Code 5-19-1(8)). A cash door-to-door purchase falls outside the statute, so the federal FTC rule is the only floor.
One year if the seller gave no noticeUntil the seller delivers the required written "BUYER'S RIGHT TO CANCEL" notice, the buyer may cancel within one year of the sale. The seller may satisfy the notice duty by using the federal FTC form instead.
Refund within 10 days, goods yours after 20The seller must return payments and traded-in property within 10 days of cancellation. If the seller does not demand the goods within 20 days after the notice, they become the buyer's property with no obligation to pay.
When there is no rightWhat it means
Cash sales have no state rightThe Alabama statute lives in the banking Mini-Code and reaches only credit sales, so a cash door-to-door buyer relies solely on the federal FTC rule.
Motor vehicles are excludedA car is expressly written out of the home-solicitation definition, so a vehicle sold in your driveway is not a home solicitation sale and carries no three-day right.
Store and prior-negotiation salesSales at the seller's fixed place of business, or made after prior negotiations there, carry no cooling-off right. An emergency waiver is allowed only as a separate signed statement, never a printed form.
There is no general right to return a car or a store purchase
The cooling-off right is about how the sale happened, a salesperson at your door, not the price. It does not cover a car you signed for, or an ordinary store purchase. Those are final absent fraud or the seller's own return policy.
Federal floor
The FTC Cooling-Off Rule (16 C.F.R. Part 429) gives three business days to cancel a door-to-door sale of $25 or more at your home, whether you paid cash or credit. Alabama beats it on the one-year no-notice window and the 20-day goods forfeiture.

What you can do right now

Concrete, neutral steps to cancel a covered purchase in Alabama. This is consumer information, not legal advice.

  1. Check whether the sale was financed

Alabama's three-day right reaches only credit-financed door-to-door sales. If you paid cash, use the federal FTC rule instead, which covers cash and credit alike.

  2. Cancel in writing within the window

Send written cancellation to the seller by midnight of the third business day. Keep proof of the date you delivered or mailed it.

  3. If you got no notice, you have up to a year

If the seller never gave the written cancellation notice, you can cancel within one year of the sale by notifying them in any way. Note the date they should have given it.

  4. Complain if a valid cancellation is refused

If a seller ignores a timely cancellation, file a complaint with the Alabama Attorney General's Consumer Interest Division.

File a complaint in Alabama

If a seller refuses a timely, valid cancellation, a state consumer-protection office can take your complaint and enforce the cooling-off rules.

What Alabama buyers get wrong about cancelling

Alabama's cooling-off right lives in the banking code, the 1971 Mini-Code, which is why it only reaches credit sales. Under Ala. Code 5-19-12 a buyer of a credit-financed home solicitation sale can cancel until midnight of the third business day after signing. Pay cash at your door and the Alabama statute does not reach you at all, so the federal FTC rule is your only protection. Alabama also expressly writes motor vehicles out of the definition, so a car sold in your driveway is not a home solicitation sale. Two features make the statute stronger than the federal floor. First, if the seller never gave the written "BUYER'S RIGHT TO CANCEL" notice, the clock never starts and you can cancel for a full year. Second, if the seller does not come back for the goods within twenty days of your cancellation, they become yours free. The statute even lets a seller satisfy its notice duty by handing over the federal FTC form, a rare express state-and-federal substitution.

Common questions

I paid the door-to-door salesman in cash. Do I still get three days in Alabama?

Not under the Alabama statute, which reaches only credit-financed sales. A cash door-to-door buyer relies on the federal FTC rule, which gives three business days to cancel a sale of $25 or more at your home.

The contractor never gave me a cancellation form. How long do I have in Alabama?

Up to one year. Under Ala. Code 5-19-12, until the seller gives the required written notice the buyer may cancel within one year of the sale by notifying the seller in any manner.

Does the three-day rule cover a car sold to me in my driveway in Alabama?

No. Motor vehicles are expressly excluded from Alabama's home-solicitation definition, so a car is not a home solicitation sale and there is no three-day right to return it.

Nobody has collected the equipment. When does it become mine in Alabama?

After 20 days. If the seller fails to demand the goods within 20 days after your cancellation notice, they become your property with no obligation to pay for them under Ala. Code 5-19-12.
