What Delaware buyers get wrong about cancelling
Delaware regulates the salesperson at your door, not just the contract. Under 6 Del. C. § 4404 you have until midnight of the third business day to cancel a door-to-door sale of 25 dollars or more, and the seller has ten business days to refund you. Two features set Delaware apart. First, the chapter is titled Unlawful practices, and it goes beyond the cancellation right: section 4405 requires a door-to-door salesperson to carry an identification card, and section 4406 restricts the hours of solicitation, both backed by fines. Second, Delaware's 25 dollar floor applies wherever the sale happened, so a 60 dollar purchase at a hotel presentation is covered, where the federal rule would need 130 dollars. Delaware's longer windows are clean: a vacation time-sharing plan can be cancelled within five business days with a refund inside fifteen days, and a health spa contract within three business days for a full refund. If the seller does not come back for the goods within twenty days, they are yours.
