Read this first: three kinds of helmet law

There is no federal helmet mandate, so the rule is set state by state and falls into three buckets. Some states require a helmet for every rider. Others require one only under a set age, usually 21, and let older riders go without if they meet a condition such as carrying medical insurance or finishing a safety course. A few have no helmet law for adults at all.

Two things catch riders out. First, an age exemption is not automatic: the older rider often has to actually carry the required insurance or training proof, or the exemption does not apply. Second, a state with no helmet law can still require eye protection, and a helmet is always the safer choice whatever the law says.
